                   	     ORDINANCE NO. 9594
                  
                  
                   AN ORDINANCE CLOSING AND ABANDONING AN ALLEY
                   LOCATED NORTHEAST FROM DUNCAN AVENUE, NORTHWEST
                   OF NATIONAL AVENUE, MORE PARTICULARLY DESCRIBED
                   HEREIN, UPON CERTAIN CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned an alley located northeast from Duncan Avenue,
         northwest of National Avenue, more particularly described 
herein,
         and as shown on plat attached hereto and made a part hereof by
         reference:
                An alleyway varying in width from 10 feet to 14
                feet, and beginning on the northeast line of Duncan
                Avenue 100 feet northwest of the intersection of
                the northeast line of Duncan Avenue with the
                northwest line of National Avenue, thence northwest
                10 feet with Duncan Avenue, thence northeast 97.36
                feet parallel to National Avenue, thence northeast
                37.86 feet to the southwest line of a 10 foot
                alley-way, thence northeast some 21 feet, on a
                curve, to the northeast line of said 10 foot alley,
                thence southwest 145 feet, crossing said alley, and
                parallel to National Avenue, to the northeast line
                of Duncan Avenue, the point of beginning.  Said
                alleyway separates lot 2, Steiner and Gibson
                Resubdivision, as shown by plat of record in plat
                book 39, page 192, R.O.H.C., from lot 9, Lukens
                Addition to Highland Park, as shown by plat of
                record in plat book 5, page 34, R.O.H.C.  Tax Map
                No. 146G-A-12 and 15.
               
               
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this closure
         and abandonment is made subject to the following conditions:
                1. Reservation of an easement the width of the
                   right-of-way for South Central Bell for the
                   purpose of operating and maintaining its
                   facilities in said right-of-way.
               
                2. The areas reserved for said utility easement
                   must be kept free and clear of all structures.
               
                3. All existing easements are retained.
               
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
